Honda Odyssey lifetime brake contracts — escalation ladder (26 Oct 2026)

VIN 5FNRL6H89LB505620 · contracts HBH36563 (front) / HBG90604 (rear) · dealer service line 365-832-6183, 170 Steeles Ave E, Milton · email already drafted (needs only the To: address).

What OMVIC can and cannot do — read this before threatening anything

From OMVIC's published Complaints Process (omvic.ca/buying/complaints/complaints-process):

The 90-day cancellation route does not apply here. MVDA s.50 lets a buyer cancel within 90 days of delivery only for six listed non-disclosures: previous taxi/limo use, police/emergency use, daily rental use, make/model/model year, branding (irreparable/salvage/rebuilt), and actual distance travelled. A "lifetime brake" representation is not on that list, so do not build the argument on s.50.

The lever that does apply

  1. MVDA "clear and truthful" representation + all-in pricing. A coverage term stated at the point of sale — and the $0.00 invoice SO#188198 dated 2026-08-27 (front rotors, rear pads + rotors, brake fluid billed at zero) — is a representation the dealer made and priced into the deal. If it now says the coverage is non-transferable or void, it is repudiating a term of the sale.
  2. Compensation Fund (MVDCF). Eligible if the dealer "has failed to remit or honour the conditions of a service plan agreement" or "the claim is for a deficiency the dealer has refused to honour." File within two years of the issue. Payout ceiling $45,000 per transaction. Applies only to purchases from an OMVIC-registered dealer — this one is. Application goes to compfund@omvic.on.ca; forms and legal documents must be originals, statements/affidavits sworn before a lawyer or commissioner of oaths.
  3. Small Claims Court (Ontario limit $35,000) is the only forum that can actually order payment. OMVIC staff are not compellable as witnesses in civil proceedings, so keep your own paper trail.

The ladder, in order — do not skip a rung

Rung Who What to do What "success" looks like
1 Service manager (365-832-6183) Ask the question in writing, not by phone: "Are HBH36563 / HBG90604 transferable to me as the retail buyer, and will you honour a front/rear brake job for me at $0.00?" Get an answer by email. Written confirmation + a contract copy
2 Dealer principal / general manager Registered letter (draft below) to 170 Steeles Ave E, Milton. Registered mail is what OMVIC itself recommends — it creates proof of delivery. Enclose bill of sale, the $0 invoice, and the VIN inquiry page showing both contracts live to 12/31/9999. A written response, or the 5-business-day clock expiring
3 OMVIC Complaints & Inquiries Online complaint form, consumers@omvic.on.ca, or 1-800-943-6002. Attach: bill of sale, invoices, the contracts page, all correspondence, and the registered-mail receipt. File assigned to a CRS; OCPA form issued
4 OMVIC Compensation Fund Only if rung 3 does not produce the brake service. Same document set, plus the CRS file number. Board of trustees decision
5 Small Claims Court Claim the retail value of two brake jobs (front pads/rotors + rear pads/rotors, installed, roughly $600-$1,200 at dealer labour rates). Judgment

Do not file rungs 3-4 before rung 2 is delivered — OMVIC's own first step is to tell a complainant to send a letter to the owner/GM, so filing early just delays the file.

Registered letter — print, sign, mail (rung 2)

Re: 2020 Honda Odyssey Touring, VIN 5FNRL6H89LB505620 — lifetime brake contracts HBH36563 (front) and HBG90604 (rear)

I purchased the above vehicle from your dealership. Its VIN record shows two lifetime brake contracts tied to this vehicle — HBH36563 for the front brakes and HBG90604 for the rear — each with no expiry date and no kilometre limit. Invoice SO#188198 dated August 27, 2026 shows front rotors, rear pads and rotors, and brake fluid billed at $0.00, which reflects that coverage.

I am asking you to confirm in writing, within five business days: 1. That both contracts are in force for my ownership of this vehicle, and the full contract terms; 2. That coverage transfers to me as the buyer, and what, if anything, I must do to register the transfer; 3. Exactly what labour and parts each contract covers, and any conditions that would void it; 4. That brake fluid and any related hardware are covered or priced transparently; 5. That you will book and perform covered brake work at no charge when it is due.

If your position is that the coverage does not transfer, please state that in writing with the clause you rely on, so I can take it up with OMVIC. I would rather resolve this directly with you.

Yours truly, Anjal Patel [address] · [phone] · [email]
